The Trademark Office does not check whether a mark in an identical or similar form already exists. Older trademark rights are considered to be the first in the register subsequent appeal proceedings if owners bring older trademark rights against the registration. Therefore it is advisable to advance, to have carried out a search for identical or similar trademarks to avoid later costly process.
